Blacklock v. Small case records, 1869-1889.

Case records consist of legal instruments and documents, notes, and correspondence. The case has to do with a mortgage and bond on property on Bull Street in Charleston (S.C.), allegedly in part paid for in Confederate treasury notes. A sworn deposition of1880 states that in 1861, John F. Blacklock "being in full sympathy with the Southern States, but desiring to avoid the dangers of the recent war went to England," taking with him his daughters, on whose behalf he had mortgaged a house on Bull Street to Jacob Small and assigned Small's mortgage and bond to Alexander Robertson, his business partner. The depostion also states that "during the war Charleston was constantly exposed to bombardment for several years and the mortgaged property was within range. Shells struck there and nearby." In 1869, John F. Blacklock's daughters, Mary, Helen, and Emma Jane, filed a bill against Jacob Small and Alexander Robertson, which was dismissed in 1871. They filed another bill in 1879, just before two of the sisters moved to Savannah (Ga.). The complainants were seeking payment of the mortgage and the funds from the sale of the property from Small. The case was heard in the Federal Circuit Court and appealed to the United States Supreme Court in 1887. The Supreme Court rendered an opinion in April 1888, ruling that the case ought to have been dismissed by the Circuit Court "for want of jurisdiction," because the principal parties involved were citizens of South Carolina.
